ddamm logoCalifornia vehicle code 23152(b) makes it illegal to drink and drive with a blood alcohol content of .08% or greater.  This limit is extremely low which is why drivers need to be aware of their limits.  The purpose of this law is to keep drunk drivers from threatening the safety of others.  Unreasonable risk and damages is required in liability for negligence, however, 23152(b) criminalizes such risk.  Drunk driving defendants can face heavy penalties without causing any property damages, accidents or personal injury.
